Justice Adolphus Enebeli of the Rivers State High court has sentenced a Police Inspector, Timothy Samuel, to death by hanging for killing one Timothy Samuel in Port Harcourt five years ago.
Justice Enebeli, however, discharged and acquainted his c-accused, Obadiah Moses, a police corporal.
Nwasuruba, a 35-year old graduate of Industrial Chemistry from Imo State University, was reportedly shot dead by Samuel in front of his pure water shop at Rumukwurusi area of Obio/Akpor local government area in October 10, 2010.
The convict, who has since been dismissed from the Force, had served for 33 years and had only two years left in service before he committed the crime.
Delivering his verdict on Monday, Justice Enebeli described the police officer as “a heartless, trigger –happy and merciless hater of human being.”
“According to section 319 of the Constitution of Nigeria, I don’t have the power to reduce your sentence, that you Inspector Timothy Samuel be hanged on your neck until you are pronounced dead,” the judge ruled.
Earlier before the sentencing, the defence Lawyer, M. J. Harry, appealed to the court to tamper justice with mercy, saying “the inspector is a husband and father of many children who has served the country for several years and has just two years to retire from the police.”
